Whatever tends to destroy the confidence of good citizens in the integrity of that court, which is the final arbiter in all controversies affecting the state or individuals, demands our most serious consideration. And after further comments upon Judge Maynard they recommend the adoption of the following resolution: Resolved, If the Assembly concur, that Isaac H. Maynard, a Judge of the Court of Appeals be and he hereby is removed from his position as such judge, pursuant to the provisions of section 11, article 6 of the constitution. All of which is respectfully submitted. Dated April 18, 1892, and signed by Charles T. Saxton, Edmund O Conor, Joseph Mullin, members of the senate committee. James R. Hoyt, Nevada N. Stranahan, William Kenedy, Myron H. Clark, members Assembly committee. And those were the Republican members. MR. STAXDART: I take it, the majority report did not discuss the proposition rs to what should be done in the matter; they did not wish the application of section 11 in the majority report? MR. STEVENS: Onfy what I have read to you. Now, you will see clea1ly from thisthis is really what I have been going over this entire matter for--that the decision of the majority of the committee, whatever it was, was based upon the facts and not upon the law.' They did make an expression of their opinion but their decision was not based upon that ground, because under their decision the question now before you did not come up.
